hey everyone i know it been a lit bit since i last posted (been really busy, plus i have really slow internet at the moment)
but my mom was in a car accident the other day in her car and i know the insurance company is going to try to total it and give us way less then it was worth to us.

so what hapend tho was my mom was on her way home from work and some asian lady on a side street stoped at a stop sign and didnt look both ways then floored it and ran right it to the side of my mom the lady admited fault and the seattle police wrote and accident report and everything. as far as the car gose the front passgerside axle and shock are busted so the cars nose is sitting on the ground and cant drive.

i will admit that we are lucky cause my mom is fine for the most part (she is going to get her back looked at today). and the cop at the accident knew that my mom didnt have insurance and her driver lincese was expired but he didnt give us any tickets.

so the lady that hit my mom admited fault and has insurance so we will get something out of it but probley not much cause the car is a 1990 mitsubishi galant and the blue book on it is only 600-1200 dollars so im sure they will total it and give us somewhere in that range of money but it sucks cause that car was in prefect shap inside and out other then it burnt a little oil. and there is no way we will be able to replace it with a car just as good for that price.plus i really kinda like that car cause it was kinda rare i never saw many that were the same year plus there arnt any the same year for sale at the moment. so i was just wondering what u guys think?

Accidents suck. It's just what happens when you drive an older car like that. They become throw-aways. Nothing you can really do if you can't fix it yourself, or come up with the extra $ to have a shop fix it.

Sorry to be the dick here, but your Mom needs to have insurance and a non-expired license if she's going to be on the road. -It's the law.

You'll actually be lucky to get anything if the other ladies insurance finds out that information.

Book on that car is $1850 dude. Take that money and buy something better than a Japanese Mopar.

BTW, driving without insurance is a $400+ fine, plus having to carry an SR-22. No bueno.

Agree on part of owning an older car. They never do give you what a car is worth.

Cop was VERY nice. Here that could turn the whole situation around and make it comepletely your moms fault. Also as mentioned, if the others company finds that info out, they may not have to pay at all.

What I dont know is what Aaron said... does getting popped for no insurance and no liscense = sr22 when you go back to being legal?

What I always understood was that if you drive without insurance, and then hit someone (which his Mom did), it's an SR-22. I don't know the specific RCW to back that up though.

What I could get out of the legalese is that driving without insurance is a traffic infraction with a penalty of up to $250

This defines as traffic infraction

http://apps.leg.wa.gov/RCW/default.aspx?cite=46.30.020

And this defines the penalties

http://apps.leg.wa.gov/RCW/default.aspx?cite=46.63.110

I couldn't find anything relating to SR-22, but then I didn't read very deep into it.

Shoulda told that to the cop who wrote me a $420-ish ticket for driving without insurance just because the card in the car was a week expired (insurance was still on the car too Rolling Eyes).

today the insance company sent some one to look at the car and they did say that they are going to total it and they said (from what i can understand) that the way they decide what we get for it is they look at the car then try to find the closest thing to it in 150 miles and go off that price which could work out better for us. so now its just a a matter of waiting to find out what we could get.

well for thoses of u that care i got good news. the car is totaled but we are geting 3500 for it plus they are giving us tax and licensing for it and we are geting a few hundred for not taking a rental car. so we are geting about 4200$ Surprised . and this isnt even counting the money we are gona get for my moms injuries and her missed time at work plus the 50$ we have to get payed back for the rental of a car dolly to tow the thing home.
the insurance company also apologized for taking so long due to the fact they couldnt find any 1990 galants to compare to and give us a price.so the car should be geting picked up sometime next week and we should get are check soon after.i am just confused cause i always hear that it takes months to get a insuance company to pay up and when they do its never what the car is worth (wich i guess is still true cause no way in hell was it worth 3500$) i thought i was crazy to hope for 2000-2500$ for it

that can bite you in the butt. Insurance company and the cop can legally make your mom at fault even if its the other drivers fault. insurance company will review the police report as required. Vehicle was not supposed to be on the road. if ins company pursues this in court cop can write a ticket later. and having to pay for the other drivers damage. The legal response from the police and ins company ; the Car was not supposed to be to on the road until is was insured and licensed (legally the car uninsured and unlicenced is at fault).

Its a good thing she got a lucky break.
